GENERAL TERMS OF USE OF eSIM SERVICE
("Terms")

INTRODUCTORY PROVISIONS

1.1. Contracting parties.This document governs the contractual relationship between (a) Tapsim (“Service Provider”, “Company”, “we”, “us”, “our”) and (b) any natural or legal person who purchases, installs or otherwise uses an eSIM profile (“User”, “you”, “your”).
1.2. Acceptance.Any purchase, installation or use of an eSIM constitutes the User's irrevocable and unconditional agreement to all provisions of these Terms, without limitation or exception.
1.3. Language.The authentic and legally binding version of these Terms is exclusively the one drawn up in the English language, in the Latin alphabet; any possible translation has an exclusively informative character.

DEFINITIONS

2.1. "eSIM" means an electronic SIM profile (Remote SIM Provisioning) that provides access to the partner operator's mobile data network.
2.2. "Package" means a pre-paid data plan of the specified nominal size (GB) and duration (days) specified at the time of purchase.
2.3. "Validity period" is a period of time in days that begins with the moment of the first successful registration of the eSIM in the partner network and ends with the expiration of the last day of that period, regardless of the amount of data used.
2.4. "Activation Period" is a period of 180 (one hundred and eighty) calendar days from the date of purchase, within which the User must activate the eSIM; if the deadline is missed, the Package is irretrievably lost.
2.5. "Dispute Event" means any fact on the basis of which the User claims a refund, damages or any remedy.

SUBJECT AND SCOPE OF THE SERVICE

3.1. Character of the service.The company provides data-only transmission within the territory of the Republic of Greece, without voice or SMS services and without an MSISDN assigned.
3.2. Technical limitations.The service is not subject to an internal fair-use policy or to a conscious reduction in throughput by the Company; however, the ultimate quality (speed, latency, coverage) depends solely on the third party - the partner mobile operator - and local radio conditions.
3.3. Permitted use.The user is allowed to use tethering (hot-spot) without quantity limitations; any further distribution or resale of the Package is strictly prohibited.

OBLIGATIONS AND RESPONSIBILITIES OF THE USER

4.1. Device.The user determines independently and before purchase whether his device is: (i) unlocked for all networks and (ii) compatible with eSIM technology.
4.2. Incompatibility Waiver.Under no circumstances will the Company grant a refund, exchange, credit or other compensation if the device is found to be incompatible or technically defective.
4.3. Profile security.The user bears the sole responsibility for saving account access data on http://tapsim.net and restricting access to third parties.

PACKAGE ACTIVATION AND DURATION

5.1. Activation deadline.By not submitting the request for the initial installation of the eSIM within the period specified in Article 2.4, the User irrevocably loses all rights from the purchase, with the Company retaining the payment.
5.2. Beginning of the Validity Period.The validity period starts with the first successful signaling of the IMSI of the eSIM in the partner network, regardless of whether the User is aware of that registration.
5.3. Termination.The Package expires (i) at the expiration of the Validity Period or (ii) when the nominal amount of data is fully used, whichever occurs first.

EXCLUSION OF WARRANTIES AND DISCLAIMER OF LIABILITY

6.1. Reasonable efforts.The Company will implement reasonable technical and organizational measures to provide the Service, but does not guarantee continuity, accuracy, reliability, availability, or minimum throughput.
6.2. Force majeure and external events.The Company is not responsible for any interruption or degradation of the Service caused by the act or omission of third parties, force majeure or measures of government authorities.
6.3. Limitation of liability.The total cumulative liability of the Company towards the User, regardless of the legal basis, is limited exclusively to the sum paid by the User for the respective Package (cap of liability); any indirect, consequential, punitive or lost profits are strictly excluded.

PRICES, PAYMENT AND CHARGEBACK

7.1. Currency and methods.All transactions are calculated in euros (EUR) and are carried out exclusively through payment cards, Google Pay or Apple Pay.
7.2. Initiating a chargeback.By opening a dispute with the payment processor, the User immediately loses the right to an internal complaint procedure and agrees that the Service will be deactivated without delay until the dispute is resolved.
7.3. Administrative costs.The company reserves the right to claim the costs incurred in processing an unfounded chargeback, in accordance with the rules of the card schemes.

REFUND POLICY

8.1. Deadline for submission.A written request must be submitted through the user's account no later than 30 (thirty) days from the date of purchase.
8.2. Technical verification phase.The user is obliged to cooperate with technical support for at least 7 (seven) working days (delivery of encountered screens, reset of network settings, sending of log files, etc.).
8.3. Invalid grounds.Unused megabytes, subjective dissatisfaction with speed, as well as device incompatibility are not grounds for refund.
8.4. Merit decision.If, in the procedure referred to in paragraph 8.2, a technical malfunction exclusively attributable to the Company is established, the User is offered (a) a replacement Package of the same nominal value or (b) a refund of the entire purchase amount - the Company's sole choice.
8.4. The user is not entitled to another refund.

SUSPENSION AND TERMINATION

9.1. Discretionary right of suspension.The Company may, at its sole discretion, temporarily suspend or permanently deactivate the User's Service in the event of fraud, abuse, excessive or illegal traffic, chargebacks or violations of the law.
9.2. Data deletion.Upon permanent termination, all personal data of the User are immediately deleted, except for those stored for tax and accounting regulations (maximum 7 years).

FORCE MAJEURE

10.1. Unavailability.Neither party shall be liable for any default caused by events beyond its reasonable control, including but not limited to: natural disasters, acts of war, terrorist attacks, regulatory prohibitions, general disruption of telecom infrastructure.
10.2. Notification.The party affected by force majeure shall, when reasonably practicable, notify the other party; The absence of notice does not affect the release from liability.

GOVERNING LAW AND JURISDICTION

The owner and representative of the brand TapSim owned by Midl Group located at 71-75 Shelton Street, Covent Garden, London WC2H 9JQ, United Kingdom.
11.1. Governing law.These Terms shall be construed and enforced exclusively in accordance with English law.
11.2. Jurisdiction.The courts of London (UK) shall have exclusive jurisdiction to resolve all disputes, the User irrevocably consenting to such jurisdiction and waiving the objection of "forum non conveniens".

AMENDMENT AND UPDATE OF TERMS

12.1. Right of modification.The Company may, at any time, amend or supplement the Terms by posting a revised version at http://tapsim.net; changes take effect on the date of publication, unless otherwise indicated.
12.2. Tacit consent.By continuing to use the Service after the publication of amended Terms, the User is deemed to have accepted all amendments without limitation.

INTEGRITY OF AGREEMENT AND SEVERABILITY

13.1. Wholeness.These Terms, together with any policies expressly referred to, constitute the entire agreement between the User and the Company.
13.2. Separability.If any provision of these Terms is declared invalid or unenforceable, such provision will be replaced by the provision that best matches the purpose of the original, while the other provisions remain in force and produce legal effect.
